Lawful Presence at Adams State College

Effective August 1, 2006, Colorado law requires students 18 years or older who are receiving a "public benefit" to prove they are lawfully present in the United States.

Who is required to show proof?

All students 18 years or older receiving benefits on or after August 1, 2006, are subject to the requirements of the bill.

What are public benefits?

Tuition benefits: In-state tuition, WICHE/WUE tuition, College Opportunity Fund (COF) stipends, military and athletic tuition waivers, Native American tuition waiver, International Exchange tuition benefit and any other state or institutionally funded financial benefits.

State financial aid: Need-based financial aid, merit aid.

Institutional financial aid: First Generation award, Academic Excellence award, transfer student scholarship, athletic scholarship, need-based grants, etc.

How do I provide proof of lawful presence?

Students who submit a completed FAFSA are verified through the U.S. Department of Education and do not need to submit documentation proving lawful presence. For students who do not complete the FAFSA, the following steps must be taken:

Step one: Sign the Affidavit of Legal Presence Form (PDF).

Step two: Provide an acceptable form of identification.

Step three: Submit the signed affidavit and copy of an acceptable form of identification in person, by mail, or by fax to the Adams State College One Stop Student Services Center.

What happens if I do not prove lawful presence?

The above-mentioned tuition and financial aid benefits are revoked and your residency status will be "out-of-state."
